Subscription Agreement

1.1 The Service is a cloud-based educational platform that provides access to study and practice materials, including video lessons, topic-based practice questions, answer explanations, review tools, and exam-style practice tests. The Service is provided on an access basis only; no software is sold, downloaded for ownership, or licensed to you, and your subscription grants you no rights other than the right to access and use the Service during your paid subscription term for your personal, non-commercial use.

1.2 The Service is provided for educational purposes only. The Company is an independent educational platform and is not affiliated with, endorsed by, or sponsored by any state Department of Motor Vehicles (DMV) or other government agency, and does not guarantee that any Subscriber will pass an official DMV examination.

2.1 A subscription requires a registered account. You agree to provide current, complete, and accurate account and payment information and to keep it updated. You are responsible for all activity under your account and for maintaining the confidentiality of your login credentials.

3.1 We may offer a three (3) day free trial to new users who register for the Service. Unless you cancel before the end of the free trial, your subscription will automatically begin and your payment method will be charged the applicable subscription fee for the plan you selected. You may cancel at any time during the free trial through your account to avoid being charged. If you start a free trial through an App Store, the trial, its conversion to a paid subscription, and any related billing and cancellation are managed by that App Store and governed by its terms, and you must cancel through that App Store before the end of the trial to avoid being charged.

4.1 You agree to pay the subscription fees for the plan you select at the prices in effect at the time of purchase, plus any applicable taxes. All fees are stated and payable in US dollars. For subscriptions purchased through our website, we accept payment by Visa, Mastercard, American Express, and Discover, and payments are processed by our third-party payment processor. For subscriptions purchased through a mobile application, payment is collected and processed by the applicable app store platform (such as the Apple App Store or Google Play) in accordance with that platform's terms, and the App Store Purchases section below applies.

4.2 You authorize us (and our payment processor) to charge your designated payment method for all fees when due. You agree to keep your payment information current so that recurring charges can be processed.

4.3 App Store Purchases. If you purchase a subscription through the Apple App Store, Google Play, or another third-party application platform (each, an “App Store”), your purchase, billing, automatic renewal, cancellation, and refunds are handled by that App Store and are subject to its terms and policies, which may differ from and control over the corresponding provisions of this Agreement to the extent of any conflict. We do not receive or process your payment card information for App Store purchases, and we are unable to bill, cancel, or refund such subscriptions directly. To manage, cancel, or request a refund for an App Store subscription, you must use the account settings and processes of the applicable App Store.

5.1 Your subscription will automatically renew at the end of each billing cycle for a subscription period of the same length, and your payment method will be charged the then-current fee, until you cancel. The length of your billing cycle depends on the plan you selected at signup.

5.2 By subscribing, you consent to these recurring charges on a periodic basis without requiring prior approval for each charge, until you cancel. Before you are charged, and as required by the California Automatic Renewal Law and other applicable law, we will present the automatic renewal terms clearly, obtain your affirmative consent, and provide an acknowledgment with cancellation instructions. For subscriptions purchased through an App Store, the automatic renewal terms are presented, and your affirmative consent is obtained, by that App Store as part of its purchase and renewal process, and such renewals are managed and billed by that App Store in accordance with its terms.

6.1 We may change subscription fees from time to time. We will communicate any price changes to you in accordance with applicable law, and any change will take effect at the start of the next billing cycle following notice. Your continued use of the Service after a price change takes effect constitutes acceptance of the new price.

7.1 If you purchased your subscription directly from us through our website, you may cancel at any time by logging into your account and following the cancellation process, or by contacting us at mytestdmv@gmail.com. If you purchased your subscription through an App Store, you must cancel through that App Store's subscription management settings; we cannot cancel App Store subscriptions on your behalf.

7.2 Cancellation stops future automatic renewals. Your cancellation takes effect at the end of the then-current paid billing period, and you will retain access to the Service until the end of that period.

7.3 When your subscription ends, whether by cancellation, non-payment, or expiration: (a) your access to paid features of the Service will cease at the end of the paid period; (b) no further renewal charges will be made, except for amounts already incurred; and (c) you will need to purchase a new subscription to regain access to paid features. We may retain your account and related data in accordance with our Privacy Policy.

8.1 Except as expressly stated in this Agreement or as required by applicable law, all subscription fees are non-refundable, and cancellation does not entitle you to a refund of fees already charged for the current billing period. Refunds for subscriptions purchased through an App Store are governed solely by that App Store's refund policies, and any refund request for such a subscription must be submitted to the applicable App Store.

9.1 This Agreement is effective when you purchase a subscription and remains in effect until your subscription ends and all amounts due have been paid. Provisions that by their nature should survive termination, including fees owed, disclaimers, and limitations of liability, shall survive.

10.1 This Agreement is a supplement to, and does not replace, our Terms and Conditions. In the event of a conflict between this Agreement and the Terms and Conditions regarding subscriptions, billing, or cancellation, this Agreement controls. All other matters, including disclaimers, limitations of liability, governing law, and dispute resolution, are governed by the Terms and Conditions. This Agreement is governed by the laws of the State of California.
